Users are responsible for:

• Maintaining the confidentiality of passwords and login credentials.
• Activities conducted through their account.
• Not allowing another person to misuse their account.
• Informing PToP Market if they suspect unauthorised access.

Users must meet any minimum age and legal capacity requirements applicable in their jurisdiction.

3. Personal Account and Business Profile

Every user must first create a Personal Account. A Personal Account can be used to browse and purchase products available through PToP Market.

Users who wish to sell products may create a Business Profile linked to their Personal Account. Users can switch between their Personal Account and Business Profile according to their buying or selling requirements.

Sellers are responsible for ensuring that the information provided through their Business Profile and product listings is accurate and lawful.

4. Buying and Selling at Your Own Risk

Users buy and sell goods through PToP Market at their own discretion and risk, subject to rights and protections that cannot be excluded under applicable law.

Buyers are responsible for reviewing the product description, price, condition, seller information, delivery arrangements, and other relevant details before making a purchase.

Sellers are responsible for:

• Accurately describing their products.
• Providing genuine and appropriate product images.
• Setting accurate prices.
• Disclosing relevant defects or product conditions.
• Ensuring they have the legal right to sell the products.
• Meeting their agreed obligations to buyers.

PToP Market does not guarantee the quality, authenticity, condition, safety, legality, availability, or suitability of products listed by independent sellers.

5. Prohibited Products

Users must not list, advertise, offer, buy, or sell products that are illegal or prohibited under PToP Market policies or applicable laws.

Sexual accessories, sexually explicit products, adult sexual products, and similar items are strictly prohibited on PToP Market.

Other prohibited items may include:

• Illegal drugs or controlled substances.
• Stolen goods.
• Counterfeit or pirated products.
• Illegal weapons or explosives.
• Products obtained through fraud or unlawful activities.
• Items that infringe intellectual property rights.

Sexual accessories, sexually explicit products, adult sexual products, and similar items are strictly prohibited on PToP Market.

Users involved in unlawful conduct may be subject to investigation, penalties, prosecution, or other action under applicable laws of Nepal and, where relevant, other applicable national or international laws. Any criminal or civil penalties are determined by the competent authorities or courts, not by PToP Market.

7. Harassment and Inappropriate Behaviour

PToP Market is committed to maintaining a respectful and friendly marketplace.

Bothering, threatening, bullying, abusing, intimidating, stalking, or harassing another user is strictly prohibited.

Users must not:

• Repeatedly contact another user after being asked to stop.

• Sexually harass another user.
• Threaten buyers, sellers, employees, or other persons.
• Publish another person's private information without lawful authority.
• Use the Platform to intimidate or harm another person.

PToP Market may warn, restrict, suspend, or permanently terminate accounts involved in harassment or abusive behaviour. Serious cases may be reported to relevant authorities where appropriate or legally required.

8. Friendly and Respectful Behaviour

Every PToP Market user is expected to maintain friendly, professional, and respectful behaviour.

Buyers and sellers should:

• Communicate politely.
• Provide honest information
• Respect other users.
• Respond resonably to genuine enqueries
• Avoid unnecessary disputes or abusive communication.
• Respect agreed transaction arrangements
• Use the Platform responsibly

Disagreements should be handled respectfully and without threats, harassment, or abusive behaviour.

9. Payments and Transactions

Buyers and sellers are responsible for reviewing transaction details before completing a purchase or sale.

Where PToP Market integrates third-party payment services, those services may also be governed by the payment provider's own terms and privacy policies.

PToP Market is not responsible for failures caused solely by third-party payment providers, banks, or financial institutions, except where responsibility cannot legally be excluded.

10. Delivery and Product Handover

Where delivery, courier, pickup, or another handover method is arranged between users, the buyer and seller are responsible for ensuring the agreed arrangements are clear.

Users should confirm relevant details, including:

• Delivery or pickup location.
• Delivery costs.
• Expected delivery time.
• Product condition.
• Any other agreed requirements.

Any delivery services directly offered by PToP Market will be subject to the specific terms applicable to those services.

11. Content and Product Listings

Users retain responsibility for content they upload to PToP Market, including photographs, descriptions, business information, reviews, and other materials.

By publishing content on the Platform, users grant PToP Market the permissions reasonably necessary to display, host, reproduce, and distribute that content for operating and promoting the marketplace, subject to applicable law and our Privacy Policy.

Users must not upload content that infringes another person's copyright, trademark, privacy, or other legal rights.

12. Reviews and Ratings

Where ratings and reviews are available, users must provide genuine feedback based on their actual experiences.

Fake reviews, manipulated ratings, threatening users in exchange for positive reviews, or offering improper incentives for misleading reviews are prohibited.

PToP Market may remove reviews that violate these Terms or applicable policies.

The PToP Market name, logo, app design, website content, graphics, software, and other materials owned by PToP Market are protected by applicable intellectual property laws.

14. Limitation of PToP Market's Role

PToP Market primarily provides a technology platform connecting buyers and sellers. Transactions involving independently listed products are generally made between the relevant buyer and seller.

To the maximum extent permitted by applicable law, PToP Market does not guarantee that:

• Every user is trustworthy.
• Every listing is accurate.
• Every product will meet a buyer's expectations.
• Every transaction will be succcessfully completed.
• Every buyer or seller will fulfil their obligations.

Nothing in these Terms excludes or limits any liability, consumer right, remedy, or obligation that cannot lawfully be excluded or limited.

15. Compliance with Laws

All users must comply with applicable laws and regulations when using PToP Market.

Illegal activity may be reported to relevant government, regulatory, or law-enforcement authorities where required or permitted by law.
